New Zealand legislations require that any company offering financial services or products in New Zealand must register as a Financial Service Provider (FSP). Financial Service Providers who offer their product to the public will also be required to be registered with an approved New Zealand Dispute Resolution Scheme (DRS).
Registration as a Financial Service Provider (FSP) allows New Zealand and internationally registered entities to offer financial services to a retail and wholesale clientele within New Zealand. However, in order to provide the same services on an overseas market, a New Zealand registered company is not required to hold any New Zealand issued licenses (registrations, permits, etc.), but must ensure full compliance with the applicable legislations of the country in which they are doing business.
To attain and hold a Financial Service Provider (FSP) status, a New Zealand or internationally registered company must:
- Offer financial service in New Zealand
- Have a “place of business” in New Zealand, from which all services are provided
- Hold adequate local staff representation, who will be able to transact the intended business from New Zealand
- Not have any directors or controlling owners with New Zealand criminal convictions
- Maintain its office and adequate local staff for the duration of its operations as an Financial Service Provider (FSP)
